Beauty Standard-Form Contract (美容定型化契約)

Also known as: Model Contract for Beauty Services · Prepaid package contract · Beauty service agreement · Salon package contract

A beauty standard-form contract is a service contract a salon drafts in advance and uses with every customer. In Taiwan, when selling prepaid packages, the contract should follow the Model Contract for Beauty Services and the required items published by the Ministry of Health and Welfare (MOHW), clearly setting out the services, fees, cancellation refunds, and performance guarantees.

Full definition

“Standard-form” means the shop prepares the terms ahead of time instead of negotiating them clause by clause with each customer. Because the shop writes the terms, the authorities specify what must be included and what must not, so the conditions stay fair to customers. The MOHW model contract (announced on June 8, 2023) has 26 articles plus a template for cancellation and termination notices. It covers the scope of services, membership rights, the pre-treatment health check, itemized fees, payment methods, refund calculations for cancelling before or after treatment starts, performance guarantees, booking rules, and consumer dispute handling. Under Taiwan’s Consumer Protection Act, required items count even if the contract leaves them out, and clauses that break the rules do not count.

Why this concept matters

With packages, the money comes first and the service comes later. Over time, a customer may move, their health may change, or they may have doubts about the results — and want to cancel. If “how much is refunded, how soon, and what fee applies” is not written down, it easily turns into a consumer dispute. The model contract sets rules for exactly these flashpoints: at least three days to review before signing, a cancellation fee of at most 5% of the total if treatment has not started, at most 10% of the remaining amount after some sessions, and a performance guarantee for prepayments above NT$50,000. Shops that follow it give customers peace of mind and have a clear basis in a dispute; shops whose own terms go beyond the caps find that the excess does not count, which leaves them worse off. For what applies to you, please refer to the latest announcements from the competent authorities.

How MeiYe Zhan handles it

MeiYe Zhan builds the standard-form contract into the package purchase flow, and each shop can switch it on in settings (off by default): (1) Generated from the full model text — the shop only fills in blanks such as refund deadlines, fee percentages, the member card replacement fee, and the court for disputes; numbers above the model’s caps cannot be saved. (2) Filled in automatically when a package is bought — customer and shop details, the course, number of sessions, per-session price, and total are completed for you, and several packages bought together become one contract. (3) Three ways to sign — on an in-store tablet, by QR code on the customer’s own phone, or remotely through a private link; afterwards the customer can open the link anytime to view, print, or save a PDF. (4) Recorded honestly, protected from tampering — review days are logged as they are and never ticked on the shop’s behalf; customers under 18 need a guardian’s co-signature; the signing time, device, and a digital fingerprint of the content are stored; signed contracts cannot be edited and can only be voided by a manager or the owner with a written reason.

Concrete example

A customer buys a 10-session facial course for NT$30,000 (NT$3,000 per session), and the contract sets the cancellation fee at the model’s maximum. If they change their mind before any treatment, the shop can deduct at most 5% of the total (NT$1,500) and must refund NT$28,500 within 15 days at the latest. If they stop of their own accord after 3 sessions, the 3 sessions used (NT$9,000) are deducted first, leaving NT$21,000; the fee is at most 10% (NT$2,100), so the shop must refund NT$18,900 within 30 days at the latest. If they stop after 3 sessions because they moved away, the model contract treats this as a situation neither side is responsible for, so no fee may be charged and the shop refunds NT$21,000.
